The delivery was completed between the end of 2012 and early January 2013, with Huang, the store manager, collecting a total of 13,900 yuan. However, shortly after moving into her new home, she noticed a strong, unpleasant odor coming from the furniture. More concerning was the fact that the materials used were not what had been agreed upon. She discovered that the original Liyi brand panels had been replaced with those from another manufacturer, which she believed were of lower quality.
Ms. Lin requested a redo, but Huang refused. He offered to take back the furniture, but only if she agreed to a depreciation fee. After multiple failed attempts at mediation, she decided to take the matter to court, demanding a full refund of 13,900 yuan and compensation equal to three times the contract price—41,700 yuan in total.
Huang defended his actions by stating that the Liyi brand panels were unavailable during production, and the factory had failed to replenish the stock on time. To meet the tight deadline, he claimed he used an alternative first-class multi-layer solid wood panel from another manufacturer. Although the brand was different, he insisted that the material was of similar quality and had been approved by the factory. He also argued that he was unaware the wood had been changed and there was no intention to deceive the customer.
The court ruled in favor of Ms. Lin, stating that Huang had not fulfilled the contract as agreed. He had used a different material than specified, which constituted a breach of contract. The court ordered Huang to remove and return the furniture, refund the 13,900 yuan, and pay double the amount as compensation, totaling 27,800 yuan. This decision emphasized the importance of adhering to contractual agreements and protecting consumer rights in such cases.
